AERIAL ACADEMY · LEGAL

Terms of Service

Version 2026-10-30

Privacy Policy · Risk acknowledgment and waiver

The school and your agreement

Aerial Academy is operated by Oksana Zaitseva, a self-employed provider in Alberta, Canada. These Terms cover our website, applications, free programs, memberships, lessons, downloads and community. Our Privacy Policy explains how we handle personal information. By checking the agreement box and submitting an application or purchase, you accept these Terms, including the risk acknowledgment and waiver below.

Eligibility and programs

You must be legally able to agree on your own behalf. Otherwise, a parent or legal guardian must contact us before you apply or participate; a general checkbox or informal parental permission is not enough. Any participation by a minor requires a separately confirmed lawful arrangement. We welcome participants wherever the service can lawfully be provided and supported by the platform. Applying does not reserve a place or grant access. The program page or checkout states the content, dates, access period, commitments, price and promotional conditions; those disclosed details form part of your agreement. Free access lasts only for the stated period and never becomes a paid subscription without a separate purchase. Required feedback is disclosed before joining; honest criticism is welcome. Progress videos, public reviews and permission to publish are optional.

Payments, cancellation and refunds

Before payment, checkout will disclose the price, currency, taxes, billing frequency, included access, promotion and later regular price, and any automatic renewal. Recurring charges require your express agreement. Cancel future renewals using the method provided with your purchase or by contacting us; the purchase terms explain when cancellation takes effect and access ends. Any voluntary refund policy will be disclosed before payment. You may contact us about refunds, service problems or duplicate or unauthorized charges. Mandatory cancellation, withdrawal, refund and other consumer rights remain; starting a lesson does not automatically waive them.

Accounts, content and community

Keep your account accurate and your login private. Access is personal; do not share or resell it or redistribute our materials without permission, except as law permits. You may use lessons and downloads for your own learning. Treat others respectfully; do not post unlawful, harassing, misleading or private material or present risky advice as individualized professional instruction. You retain rights in your contributions and permit only the storage and display needed for the purpose and audience you chose. Public use of your name, testimonial, photo or video requires separate permission. If we publish a testimonial, we will disclose any free access, discount or other benefit received; rewards never depend on positive sentiment or publication permission.

Service changes

We may maintain the service, remove unlawful or unsafe content, or restrict access for a serious breach or legal requirement. Where practicable, we will explain and allow a response. We respect mandatory notice, refund and other rights when changes materially affect paid services. We do not guarantee results, uninterrupted service, future content, live sessions or a release schedule unless expressly included in the offer. Contact us if a technical problem prevents access to a purchase.

Risk acknowledgment and waiver

READ CAREFULLY: THIS SECTION RELEASES CERTAIN LEGAL CLAIMS, INCLUDING ORDINARY NEGLIGENCE WHERE PERMITTED BY LAW. You may ask questions or decline before agreeing or participating.

Risks and training responsibilities

I understand that aerial silks, conditioning and flexibility training can cause serious injury or death, including falls, entanglement, equipment or rigging failure, collision, overexertion, sprains, fractures, head or spinal injury and paralysis. Risks may be unforeseen and remain despite precautions. I will use suitable equipment, correctly installed and professionally assessed rigging, an appropriate crash mat and training space, suitable progressions and qualified in-person instruction or supervision when needed. I will warm up, avoid practicing when impaired and stop for pain, dizziness, loss of control or uncertainty. If I cannot meet the conditions needed for an activity, I will not attempt it.

Limits of online instruction and voluntary participation

Recorded lessons cannot inspect or certify my setup, assess my readiness, spot me or supervise me onsite. Application approval does not approve my equipment, environment or ability to perform a movement. Instruction is educational, not medical advice, rigging certification or a guarantee of safety or results. I will seek suitable professional advice when needed. I choose voluntarily whether and how to participate and, to the extent permitted by law, knowingly accept the risks, including those arising from my decisions, environment, other people and the limits of remote instruction.

Release and rights that remain

To the fullest extent permitted by applicable law, I release Oksana Zaitseva, operating as Aerial Academy, and people delivering instruction for the school, from claims for personal injury, death or property damage arising from my voluntary participation, including ordinary negligence in providing that instruction. This release does not cover gross negligence, fraud, intentional misconduct or any liability or remedy that cannot lawfully be waived. It does not release an unrelated studio, rigger, equipment supplier or other third party. Mandatory consumer and other non-waivable rights remain. An unlawful provision is limited or severed only as law permits, without expanding another provision. Enforceability depends on the applicable law and circumstances.

Law, versions and contact

Alberta law and applicable Canadian federal law govern, subject to mandatory protections and available forums in your place of residence. These Terms do not require arbitration or prevent complaints to regulators. Contact us first about concerns or questions. We retain the accepted edition; material changes require notice or fresh agreement where applicable and do not silently replace earlier agreements. Acceptance does not authorize marketing or public use of your materials. Contact: Oksana Zaitseva, Aerial Academy. Email [email protected]. Mailing address: 99 Spruce Place, Calgary, AB T3C 3X7, Canada.
